The American Lung Association gave Shelby County an “F” grade for its smog levels, highlighting the severity of the situation.

Businesses in Tennessee are typically required to obtain permits for operating the types of turbines used by xAI. These permits would establish emission limits, efficiency requirements, and air quality testing to ensure compliance with environmental regulations. SpaceX, another venture of Musk, has faced regulatory issues for discharging industrial wastewater without permits at its launch facility in Texas. Similarly, The Boring Co., another Musk venture, was fined for discharging wastewater into the Colorado River without proper permits. Tesla, under Musk’s leadership, was also cited for violating air pollution regulations in 2021. This pattern of non-compliance has raised questions about Musk’s approach to environmental regulations across his companies.

The concerns raised by environmental and health advocates highlight the potential risks to public health posed by xAI’s operations. The emissions from the turbines could have serious consequences for residents in the area, particularly those with pre-existing respiratory conditions. The lack of transparency and public input in the project further exacerbates these concerns, as residents may not be fully informed about the risks they are facing.

While xAI has been using gas combustion turbines to power its data center, its long-term plan is to switch to power from the local utility, Memphis Light, Gas and Water and the Tennessee Valley Authority. The utility has already started providing power to xAI, but the company requires additional capacity to meet its needs. This transition is expected to reduce the environmental impact of xAI’s operations, but questions remain about the overall sustainability of its practices.

The controversy surrounding xAI’s environmental impact and permit issues raises broader questions about corporate responsibility and regulatory compliance.
